1. Agreement to Terms

By accessing or using Neue•Camera (the "Service"), operated by Neue Camera (based in Slovakia), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Neue•Camera provides AI-powered design tools, including image and video generation capabilities, canvas editing, and project management. The Service utilizes third-party AI models to generate content based on user inputs.

3. AI Act Compliance & Transparency

In compliance with the EU AI Act:

AI Interaction: You acknowledge that you are interacting with an Artificial Intelligence system. The content generated by the Service is created by machine learning models and not by humans.
Content Marking: We may apply metadata or visible watermarks to generated content to identify it as artificially manipulated or generated, where required by applicable regulations.
Limitations: AI models may occasionally produce inaccurate, offensive, or biased content ("hallucinations"). You verify the accuracy of any generated content before relying on it.

4. User Accounts & Subscriptions

Registration: You must provide accurate and complete information when creating an account via Clerk.
Subscriptions: Certain features require a paid subscription managed via Polar. You agree to the pricing and billing terms presented at the time of purchase.
Refunds: Subscriptions are non-refundable generally, except as required by the applicable laws of Slovakia or EU consumer protection regulations.
Quotas: Your account is subject to usage limits (e.g., images/videos per period) based on your plan.
Age Restriction: You must be at least 18 years old to use the Service. By accessing the Service, you confirm that you meet this age requirement.

5. Intellectual Property Rights

Your Inputs: You retain all rights to the text prompts, images, and other content you upload to the Service.
Generated Content: Subject to these Terms and our third-party providers' terms, you own the rights to the images and videos you generate using the Service. You are free to use them for commercial and non-commercial purposes.
Platform IP: Neue Camera retains all rights to the interface, design, code, and proprietary algorithms of the Service.

6. Acceptable Use Policy

You agree not to use the Service to:

Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful.
Create "deepfakes" or non-consensual sexual content (NCSC).
Infringe upon the intellectual property or privacy rights of others.
Reverse engineer or attempt to extract the source code or model weights of the Service.

We reserve the right to suspend or terminate accounts that violate this policy or utilize the AI generation features for prohibited purposes.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties regarding the quality, accuracy, or reliability of the AI-generated content.

8. Limitation of Liability

In no event shall Neue Camera be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Service.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Slovakia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Slovakia.
